Understanding Bankruptcy Exemptions

One of the most important conversations we have with clients considering bankruptcy is about what they can keep—their property and assets. Attorney Jon Gold, partner at Reynolds and Gold Law, explains that understanding exemptions is critical when filing for bankruptcy in Missouri.

When you file for bankruptcy, the court reviews your property and assets. In some cases, if you have valuable assets with significant equity, the court can liquidate those assets to repay creditors. However, Missouri law offers a set of exemptions designed to protect certain assets during bankruptcy.

These exemptions are determined by Missouri state law—not federal bankruptcy law—and they apply only up to specific dollar amounts. Here are some of the most common examples:

  • Vehicle Exemption: You can exempt up to $3,000 in equity in one vehicle. If you own multiple vehicles or have more equity in one than the limit, the rest may not be protected.
  • Homestead Exemption: Missouri allows an exemption of up to $15,000 of equity in your home. For example, if your house is worth $200,000 and you owe $150,000, that leaves $50,000 in equity—well over the exemption limit, which could put your home at risk in bankruptcy.
  • Household Items: Each individual is allowed a $3,000 exemption for personal items like furniture and appliances. In most cases, the resale value of used household items falls within this amount, meaning most people don’t lose their belongings.
  • Other Exempt Items: Some additional items, such as life insurance policies and money in the bank, may also have partial protections depending on the amount and the source of the funds.
